This website is operated by an experienced photographer. By accessing and using this website, you agree to comply with the following terms and conditions, which apply to all visitors, users, and customers of the site. To access the site, you have to agree to any of these terms and conditions.
Services
The photographer offers photography services in a variety of areas, including wedding photography, bridal photography, night shot photography, wedding reception photography, black and white photography, and drone photography. The Photographic style is open to interpretation. All services are subject to availability and the terms specified for each session type.
Reservations and Payments
To book a photography session, a non-refundable payment or deposit is required. Full payment must be made prior to the session or as agreed upon. Rates and prices for services are subject to change without notice. However, clients will be informed before making any payment.
Deposit details
A non-refundable booking fee of €250 is charged to secure photographic services on the Wedding Date when the Client signs this Contract. This charge covers admin fees. This Contract will only come into effect when this Fee has been paid. The outstanding balance of the selected package shall be paid in full the week prior to or on the morning of the wedding day. Failure to make payments by the due dates may result in cancellation of this wedding photography agreement. Client may pay the instalments by cheque, cash, or bank transfer IBAN IE72AIBK93547635070087. Cheques shall be made payable to Tony Clancy Photography and mailed to: [email protected].
Copyright
All photographs taken by the Photographer at the Event, in whatever form, are copyright protected. Photographer will allow reproduction and publishing for personal use (eg, wall hangings at home, Facebook, blogs), but any sale or publication for profit without Photographer’s express written permission is a violation of copyright law. Photographer retains Copyright in all images taken at the Event. This clause shall survive the Term.
Fee Variations
Prices quoted for Wedding Services at the time of booking will be held up to the Wedding date. Additional products (such as wedding albums, photographic prints, wall art, etc.) will be subject to the pricing structure in force at the time of ordering.
Album, Image Catalogue and Prints
Client acknowledges that proof sizes and appearance can vary depending on the equipment used. Client acknowledges that the Photographer cannot guarantee the quality of reprints, especially when taken to any vendor or lab other than that used by the Photographer. All image and album sizes are nominal. The Photographer will provide a pleasing colour balance, but cannot guarantee exact colour matching due to the manufacturer’s printing process.
Creative License
Images are edited at the photographer’s discretion, and delivered images may not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within The Photographer’s standards. The Photographer will not be held responsible for lack of images due to inclement weather, limitations imposed by the Venue (including Churches/Hotels etc), misdirection by the Client, or uncooperative guests. The photographer will guarantee a minimum of 500 fully edited images of your day.
Digital Files (if included in package)
Digital files are corrected for colour and density and provided as high resolution JPEG files suitable for printing. These files may have received special treatment such as retouching, cropping, or lightening/darkening of selected areas. Client shall have the right to use images as follows: (1) for any personal, non-commercial purpose including display on personal websites, printing or the reproduction of copies for family, wedding guests and friends, and (2) for the publication of wedding related announcements or articles, and, when customary, include copyright reference or credit line. Client will not permit or assist in any commercial use or sale of the images without the specific consent of the Photographer.
Exhibition/Use of Wedding Images
Client understands that the Photographer may wish to use one or more of the Client’s images at a future date in its marketing or for other similar purposes. Client grants Photographer permission to display selected images resulting from this assignment as an example of the Photographer’s work (via website, blog, business cards, travelling exhibitions, etc.). The Photographer may select and send photos to magazines and/or photography competitions and will notify clients(s) if their photo(s) are chosen.
Limitation of Liability
In the unlikely event that the photographer is injured or becomes too ill to photograph the Wedding Event, the Photographer will use their best efforts to secure a replacement photographer for the Wedding Event of a similar style. If the Photographer is unable to secure a suitable replacement for the Wedding Event, responsibility and liability are limited to the return of all payments received for the event package. Further, in the event of any non-supply of images due to equipment failure, liability to the Photographer shall be limited to a re-shoot where possible or a refund of monies paid, at the option of the Client. The Photographer takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond the Photographer’s control, the Photographer’s liability is limited to the return of all payments received for the Wedding Event.
Non-Waiver
The failure of either party to this Agreement to exercise any of its rights under this Agreement at any time shall not constitute a breach of this Agreement, nor shall it be deemed a waiver of such rights or a waiver of any subsequent breach.
Cancellation/Termination
The Client may terminate this Contract at any time by giving written notice to the Photographer. The booking fee is not refunded upon cancellation. If your wedding date changes (Covid related or other) and the photographer is available on the new date, the original booking fee will be transferred to secure the new date. If the photographer is not available on the new date booking fee is not refunded due to admin fees. If cancellation occurs within 8 weeks of the Wedding Date, a cancellation fee of €500 applies. This contract will also terminate on: (1) completion and supply of the album/digital files by the Photographer to the Client or (2) 8-12 weeks depending on the time of the season. In either case, no monies previously paid to the Photographer will be refundable. Products and services ordered after this date will be subject to a new agreement and pricing.
Protection of Deliverables/Retention of Files
Photographer shall take all reasonable steps to protect the images that are recorded at the event until such time as the digital files/album is delivered to Client. Once the digital files/album has been delivered, Photographer shall have no further obligation to preserve the images of the Event, regardless of the form of media in which they are stored.
